India: RTE does not come in the way of Madarsa Education

<div dir="ltr" style="text-align: left;" trbidi="on"><br /> <div class="MsoNormal" style="text-align: justify;"><span class="Apple-style-span" style="font-size: 16px; line-height: 18px;">A section of the press has today carried a news item on the applicability of the Right of Children to Free and Compulsory Education (RTE) Act, 2009 on Madarsas.</span></div><div class="MsoNormal" style="text-align: justify;"><br /> </div><div class="MsoNormal" style="text-align: justify;"><span class="apple-style-span"><span style="color: black; font-size: 12pt; line-height: 115%;">The Ministry of Human Resource Development had issued a Guideline dated 23rd November 2010 under section 35(1) of the RTE Act clarifying that Madarsas are protected under Article 29 and 30 of the Constitution. The RTE Act does not come in the way of continuance of such institutions or the rights of children in such institutions.<iframe align="left" frameborder="0" marginheight="0" marginwidth="0" scrolling="no" src="http://rcm.amazon.com/e/cm?t=glob036-20&o=1&p=8&l=bpl&asins=8178271133&fc1=000000&IS2=1&lt1=_blank&m=amazon&lc1=0000FF&bc1=000000&bg1=FFFFFF&f=ifr" style="align: left; height: 245px; padding-right: 10px; padding-top: 5px; width: 131px;"></iframe> <o:p></o:p></span></span></div><div class="MsoNormal" style="text-align: justify;"><br /> </div><div class="MsoNormal" style="text-align: justify;"><span class="apple-style-span"><span style="color: black; font-size: 12pt; line-height: 115%;">Madarsas imparting religious instruction do not fall under the ambit of schools as defined under section 2(n) of the RTE Act. <o:p></o:p></span></span></div><div class="MsoNormal" style="text-align: justify;"><br /> </div><div class="MsoNormal" style="text-align: justify;"><span class="apple-style-span"><span style="color: black; font-size: 12pt; line-height: 115%;">However, the Ministry of Human Resource Development implements the Scheme of Promotion of Quality Education in Madarsas (SPQEM). The objective of the Scheme is to encourage traditional institutions like Madarsas by giving financial assistance to introduce science, mathematics, social studies, Hindi and English in their curriculum so that academic proficiency is attainable for children studying in these institutions. <o:p></o:p></span></span></div><div class="MsoNormal" style="text-align: justify;"><br /> </div><div class="MsoNormal" style="text-align: justify;"><span class="apple-style-span"><span style="color: black; font-size: 12pt; line-height: 115%;">The Ministry has also introduced an RTE Amendment Bill in the Parliament, which provides that School Management Committees (SMC) constituted under section 21 of the RTE Act in respect of aided minority schools shall function in an advisory capacity only, and will not be required to prepare the School Development Plan.</span></span><span class="apple-style-span"><b><span style="color: black;"><o:p></o:p></span></b></span></div><div class="MsoNormal"><br /> </div></div>
